ACMA found that the company sent more than 800 messages that violated the country’s spam laws.
The regulator also found that PointsBet had breached laws associated with BetStop, Australia’s National Self-Exclusion Register, which allows people to exclude themselves from igaming services.
BetStop was a government initiative that was launched in August 2023 and to help problem gamblers who were trying to break their addiction.
The regulator’s investigation established that PointsBet issued 508 marketing emails between August and September 2023 to people who had added their names to the BetStop register.
They also sent 705 marketing emails between September and November of the same year with a link to their gambling products with no unsubscribe option.
The sports betting operator also sent 90 texts during the same period.
PointsBet said it self-reported the messages and has strengthened its compliance processes, but Nerida O’Loughlin, ACMA chairwoman, said she was concerned that self-excluded customers received this promotional material.
“People signing up to the NSER are taking positive steps to remove online gambling from their lives. Their decision must not be compromised by companies like PointsBet,” O’Loughlin told ABC News.
