Nevada Resort Association allowed to join Kalshi lawsuit

The Nevada Resort Association has been permitted to join a lawsuit involving prediction market Kalshi.

On Monday, District Judge Andrew Gordon signed an order allowing the Nevada Resort Association to intervene in the lawsuit to represent its members’ interests after previously asking to join the case.

In March, Kalshi filed the lawsuit against the state’s gambling regulatory bodies, the Nevada Gaming Control Board and the Nevada Gaming Commission. It was in response to a cease-and-desist letter sent to the company by the regulators, the first of six such letters issued to Kalshi by state regulators across the US.

The Nevada regulators contend that Kalshi is effectively offering sports betting markets while avoiding compliance with state sports wagering regulations by offering sports prediction markets regulated by the federal futures regulator, the Commodity Futures Trading Commission.

Explaining his decision to allow the Nevada Resort Association to join the lawsuit, Judge Gordon told the Las Vegas Review-Journal that a Kalshi victory in the case could impact the Association’s members.

Gordon said, “If Kalshi prevails in this case, the NRA members likely would be placed at a considerable competitive disadvantage because Kalshi and others would not have to comply with Nevada’s comprehensive gaming laws, including prohibitions on bettors under 21 and types of bets allowed.”
