Kalshi and Polymarket accused of using NFL and NFLPA branding without approval

Prediction markets Kalshi and Polymarket have used likenesses and images associated with the NFL and the NFL Players Association without the organizations’ consent.

A Kalshi promotion highlighted the San Francisco 49ers’ and Seattle Seahawks’ clash on the opening weekend of the season, using the logos of both teams, as well as player images of 49ers Brock Purdy and Seahawks Kenneth Walker III.

A separate advertisement also used the terms NFL and Super Bowl, the latter being something the National Football League has been known to clamp down on in the past.

Polymarket, which is not yet in the US, has used NFL team names and images of Cleveland Browns player Shedeur Sanders and Washington Commanders Terry McLaurin to advertise in international markets.

The NFL has previously said it is willing to work with prediction markets, provided they meet the its demands of sportsbooks.

NFL General Manager of Sports Betting David Highhill said, “What’s important about the sports betting markets right now that are legal is that they have robust protections that include information sharing between sportsbooks and the leagues.”

Kalshi has previously argued in court that meeting these demands is too costly.

This comes after the NFL announced to its players and personnel last month that prediction markets mimic traditional sportsbooks and are, therefore, prohibited.
